Role of the Agong

Bob Kee wrote an excellent article, which I hope he won’t mind me reproducing here. But you can read the original here on his blog. This is with regards to the Role of the Agong in determining the leadership of the country.

Saya cukup hairan dengan pemimpin-pemimpin politik negara yang suka memperbodohkan rakyat. Dahlah pendidikan sivik dan kewarganegaraan kat Malaysia ni berada pada tahap yang serba kekurangan, kena pula pemimpin-pemimpin yang langsung tidak memainkan peranan sebagai negarawan yang bertanggungjawab.

Misalannya, perhatikan petikan-petikan di bawah daripada wawancara yang diberi oleh Tan Sri Muhyiddin Yassin semalam daripada beberapa sumber akhbar arus perdana :

Ketika ditanya pemberita berhubung dakwaan pembangkang yang menyebut Anwar mempunyai pilihan untuk bertemu dengan Yang di-Pertuan Agong sekiranya gagal mengadakan pertemuan dengan Perdana Menteri, beliau berkata, perkara itu tidak sepatutnya berlaku.”Jangan kaitkan Yang di-Pertuan Agong dalam hal ini. Seri Paduka Baginda adalah Ketua Negara dan tidak terlibat langsung dalam politik. Kita perlu menghormati institusi raja seperti yang termaktub dalam Perlembagaan Persekutuan,” ujarnya. Sebenarnya Perlembagaan Persekutuan meletakkan tanggungjawab melantik Perdana Menteri pada budi bicara Seri Paduka Baginda:

Perkara 40 (2)Yang di-Pertuan Agong boleh bertindak menurut budi bicaranya pada melaksanakan fungsi yang berikut, iaitu:

  1. melantik seorang Perdana Menteri;
  2. tidak memperkenankan permintaan bagi pembubaran Parlimen;
  3. meminta diadakan mesyuarat Majlis Raja-Raja yang semata-mata berkenaan dengan keistimewaan, kedudukan, kemuliaan dan kebesaran Duli-Duli Yang Maha Mulia Raja-Raja, dan apa-apa tindakan pada mesyuarat itu,

dan dalam apa-apa hal lain yang disebut dalam Perlembagaan ini.

Learning about our East Malaysian friends

Mark Teh and gang are doing this on a weekly basis, and this week the focus is on Sabah. We in Peninsular Malaysia need to wake up and realise the sorts of problems they face. Here is Deputy Suhakam Commissioner Tan Sri Simon Sipaun speaking about extremely important issues. It would also shed some light on why Sabah and Sarawak are holding such high political stakes right now.

Prayer Wall

Post a prayer up at the prayer wall

That is, if you believe in a God, or a higher being..

This is for Malaysia – the country going through upheaval.

I asked my friends the other night, whether they love Malaysia.

I do love it – not in the plasticky, fluffy way.

I love Malaysia with a deep, roaring, ferocity.

Don’t-mess-with-me-I-am-going-to-defend-the-country-and-push-for-its-betterment-mister-kind of love.

I think there is no other way to love, really.

Today’s Drama

The drama that unfolded today in Malaysia is this: (everyday there is a new episode)

  1. Prime Minister Abdullah has exchanged his portfolios with that of his Deputy Najib Razak.
  2. Abdullah now holds the Defence Ministry, whilst Najib the Finance post.
  3. Nazri becomes the de facto Law Minister, in replacement of Zaid Ibrahim who resigned a day ago.
  4. The Finance Ministry is a step up for Najib, although in actual fact the Minister of Finance II Nor Mohamed Yakcop has been the main player, running the show on the National Budget and other economic decisions.
  5. The Defence Ministry is a strategic one for Pak Lah right now, especially in light of his straightforward comment that Anwar is a threat to national security.
  6. Najib as Finance Minister will have to contend with the slowing down of the Malaysian economy. The stock market dropped to just a little above 1000 points, the lowest day for the Malaysian stock market this year. This is due to internal political instability as well as the global economic turmoil (this a day after the announcement of Lehmann brothers and the buy-up of Merrill Lynch by the Bank of America).
  7. If Najib performs well, this will allow the transition to take place at a smoother, quicker pace, apparently. Perhaps the hand over of power at a sooner date before 2010 – the stipulated year – although when exactly we are not sure.
  8. Other piece of drama is on the arrests’ front – Sheih Kickdefella was taken in this evening, in Kelantan. I have interacted with him on several occasions, and although on a rather superficial basis, find him to be an individual driven by principles.

What will happen tomorrow? Another episode in the Malaysian drama.

Tribute to Kickdefella

    And yet another of our fellow bloggers has been taken in for sedition. Apparently because of his entry calling for the flag to be flown upside down. I am worried for him. And Teresa Kok. And Raja Petra. These are the heroes of our generation. Let us not forget these names.

Sometimes music is the best balm. This is from one of my recent favourite musicals, Spring Awakening (winner of 2007 Tony Awards): “Those You’ve Known”… Dedicated to all the ISA detainees, all 65 of them in Kamunting. And a tribute to Kickdefella.

I Am Grieving

   Forgive my momentary pessimism. Today I am grieving the nation, but yet it is in deep mourning that I know is buried the desire for light to brandish itself anew.

Last night at the candlelight prayer vigil, we were asked to write prayers on the wall. And to say a word that came to mind. Some were hopeful. My word was “shadows”…

In shadows Malaysia waits

For redemptive light,

In shadows Malaysia longs

For what is right.

It groans and struggles.

All of its pains

To birth justice, peace,

Restoration again.

Your presence we desire

As we fight this good fight.

Zaid Quits Cabinet

Zaid Ibrahim has quit the Cabinet! He is probably one of the most principled men in Umno.

DATUK Zaid Ibrahim has tendered his resignation as the Minister in the Prime Minister’s Department. He has just submitted his letter to Prime Minister Datuk Seri Abdullah Ahmad Badawi.

The lawyer turned politician was appointed a minister after the 2008 general election to oversee legal affairs and judicial reform.

Zaid had over the weekend strongly criticised the use of the Internal Security Act (ISA) on three people including a journalist.

He had said that the ISA should be used only against those who truly posed a threat to national security such as terrorists.

Utusan Reports on NGO ‘Support’ of ISA

Utusan reports on NGO support of the ISA here. Apparently it is made out to show that all Malay NGOs are in support of the use of the ISA.

KUALA LUMPUR 14 Sept – Beberapa pertubuhan bukan (NGO) kerajaan menyifatkan Akta Keselamatan Dalam Negeri (ISA) masih relevan dan perlu diteruskan bagi menghalang cubaan mana-mana pihak melakukan tindakan yang boleh mengugat ketenteraman awam.

Presiden Persatuan Peguam Muslim Malaysia, Tan Sri Abu Zahar Ujang berkata, ISA sebagai undang-undang pencegahan terbukti berjaya dalam peranannya selama ini sejak ia digubal selepas peristiwa 13 Mei 1969.

Katanya, sebab itu ISA tetap relevan apatah lagi dalam negara yang didiami rakyat berbilang kaum kerana sebarang perbezaan kecil sekalipun boleh diperbesarkan pihak yang tidak bertanggungjawab hingga mencetuskan api permusuhan.

”Justeru ISA amat penting bagi mengelakkan negara porak-peranda walaupun parti pembangkang mendakwa ISA ini undang-undang yang zalim.

”Namun dalam hal ini kita perlu pragmatik. Jangan kita melompat tak tentu pasal. Sepatutnya kita jangan timbulkan pelbagai tanggapan apabila ISA digunakan hingga mencetuskan masalah lain,” katanya kepada pemberita di sini hari ini.

Beliau berkata demikian ketika mengulas mengenai tindakan ISA terhadap tiga individu yang terbabit mencetuskan isu perkauman dan persengketaan agama di dalam negara, kelmarin.

Mereka yang terlibat ialah Ahli Exco kerajaan negeri Selangor, Teresa Kok, pengendali laman web Malaysia Today, Raja Petra Kamarudin dan wartawan wanita Sin Chew Daily, Tan Hoon Cheng.

Bagaimanapun, Hoon Cheng dibebaskan di Pulau Pinang pada pukul 3.30 petang semalam.

Sementara itu, Ketua II Gabungan Persatuan Penulis Nasional (Gapena) Prof. Datuk Dr. Abdul Latiff Bakar ketika dihubungi berkata, ISA merupakan satu tindakan tegas kerajaan dalam menangani isu sedemikian.

”Perkara-perkara yang terkandung di dalam perlembagaan termasuk Rukun Negara, jika ada pihak tertentu mempersoalkannya sehingga mengundang keresahan rakyat maka mereka harus dikenakan tindakan tegas.

”Oleh itu Gapena melihat tindakan mengenakan ISA sebagai relevan, terutama ke atas mereka yang cuba menghuru-harakan negara dengan menyentuh isu sensitif,” katanya.

Dalam pada itu, Abdul Latif turut tidak menolak isu sedemikian timbul disebabkan sikap segelintir ahli politik yang mempolitikkan hal-hal tersebut demi kepentingan diri sendiri dan kaum.

”Ahli politik macam ‘over acting’ dalam berpolitik, saya percaya mereka ini ada agenda tertentu,” katanya.

Selain pengawasan pucuk pimpinan negara, katanya, Raja-raja juga perlu lebih memainkan peranan dengan kuasa yang dimiliki dalam melindungi hak-hak dan kepentingan bangsa, ketuanan Melayu dan agama Islam.

Timbalan Presiden Gabungan Pelajar Melayu Semenanjung (GPMS), Syed Anuar Syed Mohamed pula berkata, langkah mengenakan ISA merupakan satu jaminan keselamatan dan ketenteraman semua kaum di negara ini.

”Hanya melalui penguatkuasaan akta ini mampu menenangkan keadaan di dalam negara sekiranya terdapat ‘pencemaran politik’ seperti ini.

”GPMS percaya ISA bukan sahaja mampu menstabilkan keharmonian dan keamanan antara kaum, malah membantu memulihkan semula ekonomi negara selepas berdepan situasi ancaman sedemikian, ”katanya.

Sementara itu, Presiden Gagasan Melayu Perak (GMP) Datuk Seri Dr. Mohd. Hilmi Ismail berpendapat, tindakan ISA membuktikan kerajaan prihatin dengan melakukan terbaik untuk ketenteraman negara.

Menurut beliau, pihaknya yakin kerajaan tidak akan menggunakan ISA sewenang-wenangnya kecuali terhadap mereka yang dipercayai boleh mencetuskan ancaman kepada keselamatan negara.

”Tidak ada di dalam dunia ini yang tiada batasan, apa yang dilakukan kerajaan tentunya untuk tujuan kebaikan semua,” katanya.

The arrests of MP Theresa Kok and journalist Tan Hoon Cheng under the ISA following that of blogger Raja Petra Kamarudin raise grave concern for Malaysians.

An endearing legacy of Abdullah Ahmad Badawi’s leadership that we have come to appreciate is the openness albeit limited, that has come as a breath of fresh air after 2 decades of punitive control of the public sphere.

The arrests of the three individuals under the draconian law at a time when Malaysians have become more mature politically and less inclined to be baited by racial politics will no doubt further erode the legitimacy of and support for the ruling party, perhaps irrevocably.

Of no less import will be the repercussions to Malaysia’s reputation internationally, that time and again the ruling party resorts to an unjust and antiquated piece of legislation to silence dissent in order to sustain her cling to power.

It is clear to all that the arrests of MP Theresa Kok and journalist Tan Hoon Cheng are completely without justification. Tan was merely doing her job as a journalist and UMNO has undertaken the appropriate measures, including an apology from its deputy president. In the “Puchong Azan Issue”, MP Theresa Kok was arrested over what is clearly a false allegation. We urge the authorities to immediately release the two and bring to book those responsible for fomenting racial and religious hatred.

It cannot be completely denied that Raja Petra Kamarudin in his writings and those who contribute  to his blog have expressed views that many Muslims consider as denigrating the prophet and the religion of Islam. However we believe this can be countered by sound arguments based on well accepted teachings and sources of Islam. In the extreme, the authorities may take him to the Syariah court. The use of the ISA is excessive, inhumane and runs counter to Islam’s principles of justice.

In this blessed month of Ramadhan, we urge the authorities to act justly in carrying out their responsibility of maintaining the peace and  security of the country. We also urge everyone in the public sphere to exercise restraint and wisdom in discussing issues of race and religion.

Bloggers’ Vigil

  The bloggers’ vigil tonight yielded a better experience for me than the one in Bukit Aman the night before, mainly because I arrived late in Bkt Aman and the cops were literally about to leave. Tak laku.

Tonight it was raining, but I have always found standing in solidarity aneath the sheen of light showers to be quite electrically charged. Umbrellas and candles as signs of unity – now that is something else.

Nat asked me to come forward to speak, which I did, but said the same ol’ same ol’ thing about making sure we don’t fall prey to the nasty exercise of race and religion all over again. I repeat myself because there is still that large segment of the community who may be suspicious of the facts behind Teresa and RPK’s arrests. Also the need for non-violence, which thankfully by now everyone seems to have adopted as an unwritten golden rule.

It was a good vigil. Ordinary bloggers mingled with some politicians, but this was predominantly a civil society initiative. Such gatherings may not do much to change authorities’ stances of course, but it builds up energy and eventually you have an organic body that pulsates and beats to one rhythm.

There is beauty amidst chaos.

RPK on Hunger Strike

From Haris Ibrahim’s blog, RPK is apparently on hunger strike in prison. He hasn’t had food or water since Friday. This is worrying. Read more here.

“Well, RPK is on hunger strike again. No food and no water. The authorities know that his kidneys will not be able to take this for long too long. They are going to let this carry on in the hope that complications set in and that he will suffer organ malfunction.

“That’s why even though there are news reports that Teresa’s family will be allowed to see her, probably tomorrow, there is no word that RPK’s family will be allowed the same. Lawyers have already written asking that they be permitted to meet with RPK but no word yet.

“They’re going to wait until his condition is critical before they get him medical attention. By then it will be too late. RPK would already be dead.

“That’s what they are banking on. They’ll say he brought it on himself.

“You people can hold all the vigils you want. That’s not going to get him out.

“Pakatan have to move now. Anwar has to stop this nonsense of waiting for enough Malay MPs to crossover before he seeks the audience with the Agong to intimate that Pak Lah has lost the confidence of the majority of MPs in Parliament. Didn’t the rakyat reject race-based politics at the last general elections and at Permatang Pauh? Go form the federal government now.
